
Governor Greg Abbott issued a stern warning to the Texas House Democrats who left the state to prevent the stateโs mid-decade redistricting plans: any Democratic lawmaker who failed to return by 3โฏp.m. Monday, August 4, 2025, risked being removed from office.

The Democratsโ walkout effectively halted a special legislative session called by Abbott, stalling a controversial President Donald Trump-backed congressional redistricting map poised to deliver Republicans up to five additional U.S. House seats ahead of the 2026 midterms.
Abbott cited Texas Attorney General Opinion No.โฏKPโ0382 (2021), arguing that a legislator who “abandoned” or “forfeited” their duties by intentionally breaking quorum could be removed via a quo warranto court process, thereby creating a vacancy.
He says this empowers the governor to fill vacancies under Article III, Section 13 of the Texas Constitution.
โRather than doing their job and voting on urgent legislation affecting the lives of all Texans, they have fled Texas to deprive the House of the quorum necessary to meet and conduct business,โ Abbott wrote in a statement. โThese absences are not merely unintended and unavoidable interruptions in public service, like a sudden illness or a family emergency. Instead, these absences were premeditated for an illegitimate purposeโwhat one representative called โbreaking quorum.โ Another previously signaled that Democrats โwould have to go by an extreme measureโ of a quorum break โto stop these bills from happening.โ In other words, Democrats hatched a deliberate plan not to show up for work, for the specific purpose of abdicating the duties of their office and thwarting the chamberโs business.โ
Abbott also argued that campaigning to raise funds to pay $500-per-day fines imposed under House rules might violate bribery or criminal statutes.

State Rep. Jolanda Jones took exception to the threat and said Abbottโs threats are โhollow.โ

Soon after the walkout, Texas state House Republicans voted to issue civil arrest warrants for the Democrats who fled. State House Speaker Dustin Burrows said he was prepared to recognize a motion to place a call on the House or โany other motions necessary to compel the return of absent members.โ The chamber voted and adjourned.
โI will do everything in my power to establish quorum and move this body forward by any and all means available to this office,โ Burrows said. โTo those who are absent, return now. Show the courage to face the issues you were elected to solve. Come back and fulfill your duty, because this house will not sit quietly while you obstruct the work of the people.โ
The Texas Department of Public Safety was also ordered to assist in locating and arresting lawmakers who remained absent, although arrest warrants have no jurisdiction outside Texas.
“The sergeant-at-arms and any officers appointed by her are directed to send for all absentees whose attendance is not excused for the purposes of securing and maintaining their attendance under warrant of arrest, if necessary, until further order of the House,” said Speaker Burrows.
Since the Democrats are currently outside the jurisdiction of Texas authorities, their arrests remain uncertain.
The Texas House Democratic Caucus referred to the threats made against lawmakersโ seats and issued a statement: โCome and take it.โ
โIf one personโs gonna cheat and no oneโs gonna stop it, why doesnโt everyone just do it?โ said State Rep. Gene Wu, adding that his colleagues are taking it โday by day.โ
Powered by People, a political group launched by former U.S. Rep. Beto OโRourke in 2019, is supporting the Democrats’ fundraising efforts. The group raised over $600,000 in 2021, when Democrats last broke quorum.
Context: Why the walkout?
Democrats say their drastic step aims to block a midโdecade congressional map that they view as an unconstitutional gerrymander engineered to disadvantage minority voters and solidify Republican control.
โYouโve got these Texas Republicans that are just rolling over and giving Trump what he wants because heโs asked for it,โ said State Rep. Ann Johnson. โItโs an effort to every citizen, not only in Texas but the nation.โ
Critics warn that the proposal threatens equitable representation, particularly in coalition districts with strong Latino and Black populations. Democrats stress their walkout tactic is a last resort to protect core democratic principles.
โRepublicans are using the tragedy of Julyโs flooding to redraw political maps; not to deliver relief, but to enrich their power,โ said State Rep. Lauren Ashley Simmons. โThatโs why weโre breaking quorum. We stand with the people, not partisan power grabs.โ
Other Democrats said they were willing to work alongside their colleagues across the aisle.
โToday, I made the decision to leave because my Republican colleagues refuse to address priority issues that impact Texas,โ said State Rep. Barbara Gervin-Hawkins. โI am looking for a brave Republican. Grow a spine and work with us so that Trump doesnโt allow the White House to stick their arms in Texas and destroy our community.โ
Legal hurdles
While Abbott claims the legal tools for removal are solid, opponents say the threats may be legally dubious, with major constitutional questions remaining. Democrats reject the forfeiture argument as โsmoke and mirrorsโ and doubt courts would uphold any ouster without major consultation or precedent.

Thatโs not governing, thatโs gutlessโฆWeโre backing our Democratic lawmakers who are fighting against Trumpโs Texas Takeover nationwide.โ
Abbottโs threats echo past standoffs. In 2021, Texas legislators again left the state to block Republican voting restrictions. At the time, Abbott ordered arrests and called special sessions repeatedly to force a quorum.
Nationally, Democratic governors, including Kathy Hochul (NY) and J.B. Pritzker (IL), have rallied behind the Texas delegation, denouncing what they see as Republican leadership’s authoritarian effort to suppress democratic rights and minority representation.
โLetโs be clear. This is not just rigging the system in Texas,โ said Pritzker. โItโs about rigging the system against the rights of all Americans for years to come.โ
Hochul declared a symbolic โwarโ against redistricting that she dubbed undemocratic and dangerous.
โYou wonโt fight for democracy, youโre doomed to lose it,โ Hochul said. โWhat Texas and Republican states are doing at the direction of Donald Trump, I say, is nothing short of a legal insurrection against our CapitalโฆIf Republicans are willing to rewrite these rules to give themselves an advantage, then they’re leaving us no choice; we must do the same. There’s a phrase, โyou have to fight fire with fire.โ That is a true statement of how we’re feeling right now.โ
What’s at stake
If the walkout succeeds, the redistricting bill cannot proceed during this 30โday special session (running through August 19), delaying both the map and other pending measures, from flood relief to tax reform and abortion and transgender legislation.
The chamber will reconvene at 1 p.m. local time Aug. 5, per Burrows.
Should courts uphold forfeiture or vacancies, special elections could be called to fill legislative seats, potentially shifting the gerrymandering calculus. Legal battles over constitutionality and authority appear all but inevitable.
Governor Abbottโs threats mark a dramatic escalation in partisan conflict over representation, pushing Texas into uncharted constitutional territory. With Democrats standing firm, the standoff could last weeks or months, with potential ramifications for redistricting norms and quorum law.
As the fallout reverberates, Texas remains incapable of functioning while the session remains stalled and national attention intensifies.
